Terms of Service

These Terms of Service (“Terms”) govern your use of the evenstate website, tools, and services. Please read them alongside our Privacy Policy.

1. Agreement to these Terms

By accessing or using the evenstate website, tools, or services (collectively, the “Services”), you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services. If you use the Services on behalf of another person, you represent that you are authorized to accept these Terms for them.

2. What evenstate is — and is not

evenstate is an independent homeowner advocate. We help homeowners understand their wildfire risk score, document mitigation, prepare score-appeal materials, find grants and rebates, and monitor their insurability over time.

• Independent. evenstate is an independent homeowner advocate. We are not an insurance company and no insurer pays us to influence your results.
• Not a carrier. evenstate does not sell, underwrite, or issue insurance policies.
• Not legal, tax, or financial advice. evenstate provides information and documentation support, not legal, tax, or financial advice. For tax credits, confirm eligibility with your tax professional.

evenstate is not a licensed insurance producer, public adjuster, or law firm, and does not provide those services. We prepare information and documentation that you choose to submit to your insurer; we do not act as your legal representative.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide and for any credentials used to access the Services. Notify us promptly at support@evenstate.ai of any unauthorized use.

4. The Services

4.1 Free tools

Your wildfire score explained in plain English, a mitigation checklist, an appeal-letter builder, and grant/rebate matches for your area are provided free of charge, “as available.” Grant and program information is informational only; programs change, so confirm current terms with the program before relying on them.

4.2 Paid services

We offer paid services that may include the Score Audit (which includes the first year of evenstate Watch), Non-Renewal Triage, evenstate Watch (an annual membership), and professional products such as insurability letters and contractor work certification. Descriptions, inclusions, and current pricing are shown at the point of purchase and control over any general description here.

4.3 Placement referrals

If you choose a placement review, evenstate may receive a referral fee from the insurance agency that assists you. This fee is not contingent on the purchase of any policy. We disclose it up front because you should know how we're paid.

5. Fees, billing, subscriptions, and refunds

5.1 Payment processor

Paid Services are billed through our third-party payment processor, Stripe. By purchasing, you authorize us and Stripe to charge your payment method for the amounts shown at checkout, plus any applicable taxes. You agree to Stripe’s terms. evenstate does not store your full card details.

5.2 Score Audit bundle

The Score Audit is a one-time fee that includes the first year of evenstate Watch. When that included year ends, your evenstate Watch membership renews automatically at the then-current annual rate unless you cancel first (see 5.3).

5.3 evenstate Watch (subscription)

evenstate Watch is an annual membership that renews automatically each year until you cancel. You can cancel anytime — the cancellation takes effect at the end of your current paid term, and your access continues until then. Monitoring depends on the information available to us, including what you share; it is not a guarantee against insurer action. To cancel, email support@evenstate.ai or use any self-service option we provide.

5.4 Pricing

Fees are flat and disclosed at checkout. We do not offer savings-based or contingency pricing.

5.5 Refunds

You may request a full refund within 7 days of purchase, no questions asked, by emailing support@evenstate.ai. After 7 days, fees are non-refundable except where required by law. For evenstate Watch, cancelling stops future renewals; the 7-day window applies to each renewal charge.

6. Score-appeal documentation

Where you engage evenstate to help with a wildfire risk-score appeal, we prepare documentation and organize the evidence supporting your appeal. Colorado law (C.R.S. 10-4-124 / HB 25-1182) gives homeowners the right to see and appeal their wildfire risk score; evenstate helps you exercise that right. You decide what to submit, and you submit it to your insurer.

No guarantee of outcome. We can't guarantee any appeal outcome, premium, discount, or coverage decision. Those belong to your insurer. What we guarantee is evidence done right.

7. Your content, photos, and authorizations

By submitting photos and documents, you authorize evenstate to store them, review them, and use them as evidence in services you've requested. We never sell your information.

You retain ownership of the content you submit and grant evenstate a limited, non-exclusive license to store, process, and use it solely to provide the Services you requested and as described in the Privacy Policy. You represent that you have the right to submit it. We do not collect or process health or medical information, and you should not submit it.

8. Acceptable use

You agree not to:

• submit false, misleading, or fraudulent information;
• infringe the rights of others or violate any law;
• attempt to breach, probe, or overload the Services or their security;
• scrape, harvest, or copy the Services except as expressly permitted; or
• use the Services to harass or harm others.

We may suspend or terminate access for violations.

9. Intellectual property

The Services — including software, text, design, and the evenstate name and marks — are owned by evenstate or its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose. No other rights are granted.

10. Third-party services and links

The Services rely on and may link to third parties (for payment, email, hosting, mapping, analytics, grant programs, and insurers). We are not responsible for third-party content, products, or terms, and your dealings with them are between you and them.

11. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free, or that any information (including scores, estimates, or grant details) is complete or accurate. Insurance decisions — scores, premiums, discounts, coverage, renewal, and non-renewal — are made by insurers, not evenstate.

12. Limitation of liability

To the fullest extent permitted by law, evenstate and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Services. Our total aggregate liability for any claim will not exceed the greater of the amount you paid evenstate in the 12 months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless evenstate from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

14. Dispute resolution and governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@evenstate.ai and give us 30 days to resolve it informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Colorado, and you and evenstate consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. Material changes will be posted here with a new effective date and, where required, notified to you. Continued use of the Services after changes take effect constitutes acceptance.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access, with or without notice, for any violation of these Terms or as required by law. Sections that by their nature should survive termination (including 9, 11–14) survive.
